Acceptance of Terms

By accessing or using the Creative Momentum website and any related services, you agree to be bound by these Terms and Conditions and by our Privacy Policy. If you do not agree with any part of these Terms, do not use the website.

Services and Eligibility

Description of services

Creative Momentum provides website and sales funnel design, implementation, and related digital services including landing pages, checkout flows, email/SMS automation, and consulting. va-christianmamansag.systeme.io

Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to form a binding contract. By using the site you represent and warrant that you meet this requirement.

Accounts Orders and Payments

Accounts

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.

Orders and quotes

All project proposals, quotes, and invoices are subject to acceptance by Creative Momentum. A project begins only after you accept a proposal and any required deposit is received.

Payments

Payments are due according to the terms set out in your invoice or service agreement. Late payments may incur interest or suspension of services. All fees are nonrefundable except as expressly stated in a written agreement.

Client Responsibilities

You agree to provide timely feedback, content, access, and approvals necessary for project completion. Delays caused by the client may result in revised timelines and additional fees. You are responsible for the accuracy and legality of any content you provide.

Intellectual Property

Ownership of deliverables

Unless otherwise agreed in writing, Creative Momentum retains ownership of design files, templates, and proprietary tools used to create deliverables. Upon full payment, you receive a license to use the final deliverables for the purposes agreed in the contract.

License to use client materials

By providing content, images, logos, or other materials, you represent that you own or have the necessary rights and grant Creative Momentum a license to use those materials to perform the services.

Portfolio use

Creative Momentum may showcase non-confidential project work in its portfolio, case studies, and marketing materials unless you request otherwise in writing prior to project start.

Revisions Cancellations and Refunds

Revisions

Project proposals specify the number of included revisions. Additional revisions may be billed at the hourly rate or as specified in the agreement.

Cancellations

Either party may terminate a project per the terms of the service agreement. Termination may result in fees for work completed up to the termination date and for any non‑recoverable costs.

Refunds

Refunds are handled according to the terms in your contract. Unless otherwise stated, deposits are nonrefundable.

Warranties Disclaimers and Limitation of Liability

Warranties

Creative Momentum will perform services in a professional manner consistent with industry standards. Except as expressly set forth in a written agreement, services are provided “as is” and Creative Momentum disclaims all other warranties, express or implied.

Limitation of liability

To the maximum extent permitted by law, Creative Momentum’s total liability for any claim arising from or related to these Terms or the services will not exceed the total fees paid by you for the specific services giving rise to the claim. Creative Momentum is not liable for indirect, incidental, consequential, or punitive damages.

Indemnification

You agree to indemnify, defend, and hold harmless Creative Momentum and its affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms, your violation of any law, or your use of materials you provide.

Confidentiality

Each party will keep confidential any nonpublic information disclosed by the other party that is designated as confidential or that reasonably should be understood to be confidential. Confidential information does not include information that is publicly available or independently developed.

Third Party Services and Links

The website may contain links to third party websites and may use third party services (for hosting, payments, analytics, etc.). Creative Momentum is not responsible for the content, privacy practices, or terms of those third parties. Use of third party services is subject to the third party’s terms.

Governing Law Dispute Resolution and Severability

Governing law

These Terms are governed by the laws of the jurisdiction specified in your service agreement or, if none is specified, by the laws of the Philippines without regard to conflict of law principles.

Dispute resolution

Parties will attempt to resolve disputes informally. If unresolved, disputes will be resolved in the courts located in the governing jurisdiction unless the parties agree to arbitration in writing.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

Changes to Terms

Creative Momentum may modify these Terms at any time. We will post the updated Terms on the website and update the Effective date. Continued use of the site after changes constitutes acceptance of the revised Terms.
